Employment Team Defeats Class Action.
The employment litigation team of Todd Croutch and Dan Dik recently (March 2013) defeated a motion for class certification. In the matter of Daniel Hendershot v. Ready to Roll Transportation, Inc., Los Angeles County Superior Court Case No. BC 485401, three former employees, limousine drivers, sought to bring a class action upon multiple employment and wage and hour claims, against one of the premiere transportation companies in the country. Plaintiffs' counsel is a well known attorney, former multi-year "attorney of the year" per the Los Angeles Daily Journal, and a multi-year "super lawyer". The motion sought to take a case of three guys suing their former employer, and transform it into 53 people suing that company, which would have effectively bankrupted the client. Todd and Dan successfully argued that "numerosity" had not been established, and that individual issues predominated, because dozens of those prospective class members had signed settlement agreements with their employer for wages due, and others had signed bilateral agreements to arbitrate any disputes going forward. Plaintiffs' counsel have said that they will appeal.
This successful defense follows hard on the heals of a similar successful defense of an employment class action, in the matter of Guzman v. Black and White Garage, Inc., Los Angeles County Superior Court Case No. BC429452. In that case, the class action on behalf of tow truck drivers and yardmen was certified; however Todd and Dan first successfully gained summary adjudication, finding that dozens of settlement agreement were enforceable, then upon subsequent motion successfully moved for decertification of the class action. That action then settled for a nominal amount.

The patient alleged medical negligence related to a lumbar spine surgery, the post-operative development of an epidural abscess, and a delayed surgical evacuation of the abscess pressing on his spinal cord, ultimately rendering the patient with permanent neurological injury and the inability to return to work.
